Terms of Service

By creating an account or using the EncoreWorks platform (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.

The Service is operated by EncoreWorks (“we”, “us”, “our”). These Terms form a binding agreement between you and us.

You must be at least 18 years old to use the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You agree to provide accurate, current, and complete information when registering and to keep it updated.

EncoreWorks connects experienced professionals with companies seeking flexible engagements. You may use the Service only for lawful purposes and in accordance with these Terms.

You agree not to:

• Misrepresent your identity, credentials, or experience;
• Upload content that infringes intellectual property or privacy rights of others;
• Attempt to interfere with the security or integrity of the Service;
• Use the Service to send unsolicited communications or spam;
• Reverse-engineer, scrape, or extract data from the Service in bulk.

You retain ownership of the content you submit (your profile, CV, role descriptions, messages). By submitting content, you grant EncoreWorks a non-exclusive, worldwide, royalty-free licence to host, store, and display that content for the purpose of operating the Service — including matching, search, and delivery to counterparties you choose to interact with.

The Service uses automated systems, including machine learning models, to suggest matches between professionals and roles. These suggestions are informational only — they do not constitute employment offers, endorsements, or guarantees of fit. All engagement decisions rest with you and your counterparty.

Some features of the Service are offered on a subscription basis. Pricing, billing cycle, and entitlements for each plan are presented at checkout. Subscriptions renew automatically unless cancelled before the renewal date. Refund terms are presented at checkout and are otherwise governed by applicable law.

You may close your account at any time from the settings page. We may suspend or terminate your access if you violate these Terms or if continued provision of the Service would expose us or other users to legal risk. Provisions that by their nature should survive termination (intellectual property, disclaimers, limitations of liability) will do so.

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or that any specific outcome (match, hire, engagement) will result from use of the Service.

To the maximum extent permitted by law, EncoreWorks will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or business opportunities arising out of or related to your use of the Service. Our total aggregate liability arising out of or related to these Terms will not exceed the amount you paid us in the twelve months preceding the event giving rise to the claim.

We may update these Terms from time to time. Material changes will be communicated by email or in-app notice at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

These Terms are governed by the laws of the jurisdiction in which EncoreWorks is established, without regard to its conflict-of-laws principles. Any dispute arising under these Terms will be resolved in the courts of that jurisdiction.
